What can drivers expect after a DUI interlock is installed?

The Interlock: When You’ve Paid Your Dues… Now What?

Most information available on the ignition interlock will relate to why an individual needs an interlock installation, as well as how an interlock is installed in a vehicle. However, after a court date has been cleared, an individual has spoken with their DUI attorney, all fines have been paid (even if that is only the first payment), and a service center has wire hooked an interlock installed into the dash of an individual’s vehicle, what do they do now?!

The first week is the learning curve

The first week or so of living with an interlock is slightly disorienting. Initially, blowing into the interlock to start up the car is quite straightforward – once you have got used to doing it, it is not particularly difficult. However, getting used to the interlock is similar to getting used to a new pair of shoes. At first it feels okay but after a few days it starts to feel as though they are on the wrong foot and you wish that you could swap them for another pair.

First, the car will do an initial test for alcohol after it is started. This test will be at the level set by your state. If you pass the initial test the car will start to run as normal. As you are driving at random times after you have started the car the car will prompt you for a rolling retest. You will have a short amount of time (a few seconds) to provide a breath sample for the retest. If you fail a test the car will give you a retest. If you fail the retest the car will start to shut down. (This can happen while you are driving down the highway). If you fail a test the event will be logged. When you go for your next monitoring appointment the technician will be able to download the information from the interlock device and see that you had failed a test or tests. As a note, the interlock device will not shut down the car in the event of a failed test but the ignition will lock until the device is serviced.

The rolling retest feature is a problem for a lot of our customers that they didn’t even know was going to be a problem until they started actually driving around with the ignition interlock installed. The rolling retest can be set up for a number of different time frames. Typically most of the models are set up for anywhere from 5 minutes all the way up to 30 minutes after the initial startup test has been completed. The customer needs to make sure they have a good grasp on how to take a proper quality breath sample for the rolling retest. And as best they can blow into the interlock for the startup test as well as all of the subsequent rolling retests. There are a number of models that actually require the customer to Hum into the interlock as opposed to just simply exhaling into the interlock for the breath test samples. This can be a bit of a problem for a lot of customers because they don’t realize this prior to them actually installing the interlock and then they find out after the interlock has been installed. So as long as the customer has read through all of the documentation that was provided by the specific installation provider that the interlock was installed by, they will know exactly what type of startup test as well as what type of rolling retest that the specific model that they have requires.

What the device actually records

There are many circumstances that are unknown to people during the time of their DUI arrest. In addition to the initial test taken by the interlock after the vehicle has been started by the blow of the driver, the interlock will continue to record and log all information pertaining to the use of the interlock by the driver of the vehicle. Much like your financial records, the information recorded by the interlock will be retrieved periodically. In the case of an ignition interlock device, this information will be retrieved by a monitoring authority at the time of your scheduled monitoring appointments.

  • Every startup attempt, pass or fail
  • Every rolling retest result
  • Any attempts to tamper with or bypass the device
  • GPS location data, on some newer models
  • Timestamps for all of the above

There is also a lot of information stored on the interlock device that is retrieved by the monitoring agency at the driver’s scheduled monitoring appointments, typically every 30 to 60 days. The amount of information can be surprising to many and can reveal many things about a driver’s behavior. It is often said that an ignition interlock device is a very patient witness who does not forget anything and does not make excuses for a driver.

(Not that this is any excuse for not monitoring your vehicle, but) Having a service center install an ignition interlock in your car is a huge step towards learning to live with it. Worth sitting with the new reality of your car for a little while before handing over the keys to someone else.

Costs and ongoing obligations

Many DUI interlock devices are “leased” and the monthly monitoring and reporting can cost as much for a person who only drives occasionally as it does for someone who drives every day.

Comparing ongoing expenses and following practical business and personal finance insights can also make it easier to budget for installation, monitoring fees, and other long-term driving-related costs.

The violations nobody expects

One major criticism that this author has with the interlock DUI programs that are promoted by word of mouth is that even though alcohol consumption is considered to be a violation, it is not the only possible problem that can cause a violation to be registered by the interlock device. For example, failure of a start test as opposed to a retest can result in a violation being logged by the interlock even if the violation was due to Mouth Contamination. The term Mouth Contamination refers to residuals from food and drink that have been in the mouth prior to rinsing with water. Rinsing with water prior to a start test is often advised by the interlock providers.

  • Missing a scheduled service appointment
  • A failed test caused by mouthwash or certain foods (yes, really)
  • Someone else attempting to start the vehicle and failing the breath test
  • Disconnecting the battery without prior authorization

There are also instances where the failed log entry is not due to the consumption of alcohol. In many cases, rinsing the mouth out with water before providing a breath sample is recommended. However, there is still the chance that there could be residual alcohol in the mouth from eating and that could cause a failed log entry. The interlock program will not try to determine whether the failed start was due to alcohol consumption or another reason, the program simply logs the information as it occurs.

Earlier in this column I stated that DUI programs were straight forward to follow for the time being until your program is completed and you are reinstated to full driving privileges. Well I take some of that back. Most people have found that monitoring your breath for alcohol after having a drink is FEROCIOUS. Just monitoring your breath for possible interlock monitoring is tough enough as it is with or without an interlock. With an interlock monitoring your breath for possible interlock monitoring and monitoring your driving as well as your alcohol level is ferocious.

When the interlock finally comes off

One of the misconceptions that many people have about the interlock is that it is automatically removed from the vehicle on the date that the driver’s license restrictions are lifted. This is not the case. Instead, the interlock must be removed by the interlock provider after the required time period has passed and the driver’s interlock monitored usage has met the program requirements. In some states, the program administrator requires a report from the interlock provider prior to removing the restrictions from the driver’s license. Once the interlock provider has received the removal request from the driver, there is usually a wait of several weeks while the program administrator processes the request. To avoid any delays, it is best to request the removal of the interlock well in advance of the scheduled time of removal and make sure that the program administrator knows what the requirements are for removal of the interlock.

There is a huge difference between having an interlock on your vehicle and actually driving with an interlock on your vehicle. Yes, there are millions of people like you who have completed their terms of probation while driving around with an interlock on their vehicle.
